Binding Engagement and Final Payment Obligation

When you engage Negotiate For You, pay the engagement fee and instruct us to commence negotiations on your behalf, you are entering into a binding agreement for our negotiation services in accordance with these Terms and Conditions.

The initial engagement fee covers the commencement of our services. A further success fee of $900 becomes payable where Negotiate For You successfully negotiates an outcome that you approve or accept.

For the purpose of these Terms, a successful negotiation occurs when you:

  • accept a purchase price, offer, counteroffer or material terms negotiated by Negotiate For You;
  • instruct us to confirm acceptance of an agreed price or terms on your behalf;
  • enter into a contract, agreement or other commitment to purchase the relevant property, vehicle, machinery, equipment or other item; or
  • proceed with the purchase substantially on the basis of the price or terms obtained through our negotiations.

Once you accept the negotiated outcome, the $900 success fee is earned and becomes payable in full, even if you subsequently:

  • decide not to proceed with the purchase;
  • negotiate directly with the seller after our negotiations;
  • arrange for another person, company, trust or nominee to complete the purchase; or
  • otherwise withdraw after accepting the negotiated price or terms.

You acknowledge that the success fee is payment for the negotiation service and successful outcome achieved by Negotiate For You and is not dependent upon settlement, delivery, finance approval or completion of the underlying purchase unless we expressly agree otherwise in writing.

The success fee must be paid within 2 Days of the successful negotiation or upon receipt of our invoice, whichever occurs first.

If the success fee is not paid when due, Negotiate For You may take reasonable steps to recover the outstanding amount, including referring the debt for collection or commencing recovery proceedings. You may also be responsible for reasonable recovery costs where permitted by law.

Nothing in this section excludes or limits any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded.
